MARATHON COUNTY (WAOW) — The case against a Wausau man accused of voter fraud has been dismissed.

At a competency hearing Tuesday, it was established David Kitowski, 70, likely would not be found competent for trial. Both parties moved to dismiss the case, which was done, according to Marathon County court records.

Investigators said Kitowski sent in two absentee ballots with his dead mother’s name on them.

Kitowski’s mother died in January, but the ballots were sent in April and August.
