DA: Police acted in self-defense in fatal May shooting in Clark County

NEILLSVILLE (WAOW) – Two police officers acted in self-defense when fatally shooting a 51-year-old Black River Falls man in May, Clark County District Attorney Kerra Stumbris ruled Friday.

Kelly G. Abbott was killed following a high-speed chase when he got out of his car, refused to put up his hands, raised a handgun, pointed it at Loyal Policeman Jacob Schar and fired a shot, the prosecutor said.

Schar and Clark County Deputy Sheriff Nicholas Klemm returned "multiple" gunshots, hitting Abbott in the torso and limbs, Stumbris said in a two-page statement.

Abbott fired three shots during the confrontation, the statement said. Neither officer was hit.

"Both officers use of deadly force under the circumstances was reasonable and therefore privileged under Wisconsin law," Stumbris wrote. "Neither officer will be charged with any criminal offenses."

The chase began when Schar attempted to stop Abbott’s vehicle in Loyal because it did not have working taillights about 11 p.m. May 11, Stumbris said.

Special devices used to puncture tires on Abbott’s vehicle were used to get him to stop on County Highway K before the shootout, the prosecutor said.

Klemm joined the sheriff’s department about a year ago and Schar has worked in Loyal since May 2015, the state Justice Department said.
